These Terms of Use govern access to and use of arkanetai.com, the public website of Arkanet AI. By using the website, you agree to these Terms. If you do not agree, please do not use the website.

These Terms apply to the public website only. A signed proposal, statement of work, master services agreement, data processing agreement, or product agreement controls any conflict for a specific engagement.

1. About the website

Arkanet AI presents software development, AI automation, systems integration, dashboard, and compliance technology capabilities for logistics, customs, courier, and related operations. Website content is provided for general information and does not create a client, agency, employment, fiduciary, or partnership relationship.

2. Permitted use

You may access and use the website for lawful business and informational purposes. You agree not to:

  • Use the website in violation of applicable law or regulation.
  • Attempt to gain unauthorized access to the website, its infrastructure, or another visitor’s information.
  • Interfere with availability, security, or normal operation.
  • Scrape, crawl, copy, frame, republish, or distribute substantial portions of the website without written permission, except for ordinary search indexing and permitted quotation.
  • Upload malicious code or use the contact channel to send spam, unlawful content, or confidential credentials.
  • Misrepresent your identity, affiliation, or authority.

3. Intellectual property

The website, including its visual design, code, text, graphics, marks, and arrangement, belongs to Arkanet AI or its licensors and is protected by applicable intellectual property laws. Except for the limited right to view the website, no license is granted by these Terms.

The Arkanet AI name, logo, and OEA Sentinel name are brand assets of Arkanet AI or are used with permission. Do not use them in a way that suggests endorsement, sponsorship, or an affiliation that does not exist.

4. Communications and proposals

If you contact us, you represent that the information you provide is accurate and that you have the right to share it. A website inquiry is not an order, acceptance, statement of work, or commitment to deliver services. Any commercial scope, price, timeline, ownership, confidentiality, security, and service levels must be agreed in a separate written document.

5. AI and compliance information

References to artificial intelligence, automation, OEA Sentinel, compliance, customs, security, or operational readiness describe capabilities and product direction. They are not legal, customs, tax, audit, certification, or professional advice.

OEA Sentinel is an in-development SaaS concept. It is intended to help organize requirements, evidence, ownership, and follow-up for OEA certification readiness and maintenance in Colombia. It does not guarantee certification, renewal, audit results, or compliance with any authority’s requirements. Customers remain responsible for their decisions, controls, evidence, and professional advice.

AI-assisted outputs may be incomplete, inaccurate, or require human review. Do not rely on website content or an AI-assisted workflow as the sole basis for a material operational, legal, security, or compliance decision.

6. Third-party links and services

The website may refer to third-party websites, platforms, or services. These references are provided for convenience and do not mean that Arkanet AI controls, endorses, or guarantees them. Third-party services are governed by their own terms and privacy policies.

7. Availability and disclaimers

We aim to keep the website accurate and available, but we do not guarantee that content is complete, current, error-free, uninterrupted, or suitable for a particular purpose. The website is provided on an “as available” and “as is” basis to the maximum extent permitted by law.

Nothing in these Terms excludes a warranty, right, or liability that cannot legally be excluded or limited.

8. Limitation of liability

To the maximum extent permitted by applicable law, Arkanet AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of business opportunity, or interruption arising from or related to website use or reliance on website content.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other mandatory legal protections.

9. Indemnity

To the extent permitted by law, you agree to defend and hold harmless Arkanet AI and its team from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another party’s rights.

10. Governing law

Unless a separate written agreement states otherwise, disputes related to these Terms will be handled by the competent courts of the jurisdiction where Arkanet AI is legally established, under the laws applicable in that jurisdiction. Mandatory consumer or data protection rights are not limited by this section.

11. Changes and severability

We may update these Terms when the website, services, or applicable requirements change. The “Last updated” date identifies the current version. If a court finds one provision invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
